130211 [NEWS] Rain Declines to Be a Witness for Current Defamation Case Against Clothing Company
Rain, who is currently enlisted in the army, has been selected as a witness for a defamation case that was filed against a clothing company but has refused to appear in court.
According to sources from the law industry on February 11, Rain was chosen to be a witness for a case regarding a certain Mr. Lee, who owns a clothing brand company, on February 12 at 4PM at the Seoul Central Courts. However, Rain announced that he will not be attending the case hearing.
Specific details were not revealed but it seems like Rain feel uncomfortable with making an appearance due to his special status as a soldier and the recent negative media attention. The law industry sources spoke with Star News and said, “Rain declined to appear for a recent case as a witness,” and “There are situations when people decline to appear because they feel burdened by the attention.”
Criminal action suit laws state that if a witness declines a summons to testify without a legitimate reason, he or she may be fined up to 5 million won (about 5 grand). The judge for this case stated that he will wait and see if Rain has a legitimate reason for not testifying after the court date is over.
Previously, Mr. Lee was sued by spreading false truths that said Rain had seized company funds along with two reporters.
Rain was summoned to be a witness for this case last September but declined to attend back then as well. After this, Mr. Lee’s lawyers appealed that “Rain is an important witness who is needed to reveal the truth,” and was able to file another summons in January.

He is set to appear as a witness in court against Mr. Lee, who the prosecutors charged with defamation of character alleging he spread lies that Rain had stolen company funds. Rain nullified the cases against the two reporters that faced the same charges as he did. However, Rain was summoned as a witness in September last year, and he did not attend the ruling. Rain did not reply to the multiple summons after that, and Mr. Lee’s lawyer reasoned that he was an important figure in confirming all the facts, and requested again that he stand as a witness. The court accepted his request, and summoned Rain to court once more.
However, the singer submitted a declaration of absence on the 5th, stating he would not be able to attend the case. Even though details were not revealed, a legal representative said, “Rain has recently submitted a declaration stating he will not be attending as a witness. There are occasionally cases where people dislike attending because of the added attention.”
According to the law, Rain can be fined up to 5 million KRW (approximately $4,600 USD) if he is absent without having a justified reason. Rain is scheduled to appear in court on the 12th at 4PM KST, if he is absent as expected, the judge will determine if his reason is justified or not.

In the special feature for the Lunar New Year of KBS 2’s Star Family Show Mama Mia that aired on February 11, Sistar’s Hyo Lyn, Hong Rok Ki, Kim Young Hee, Heo Kyung Hwan, and the anchor Ga Ae Ran appeared with their mother.
In the segment titled “Karaoke with a cow,” Mir said, “I’ve only been doing rap and will be so,” showing his intention to bring his elder sister on stage to sing for him.
